Term of Use

PLEASE READ THIS TERMS OF USE (the “TOU” or “Agreement”) CAREFULLY BEFORE USING THE MELT TECHNOLOGY COMPUTER LEARNING CENTERS, INC.'S WEBSITE (the “Site”) OR ANY SERVICE PROVIDED THEREIN (“Service”).  This TOU is between you (“You”, “Your”, and “Yours”) and Melt Technology Computer Learning Centers, Inc. (“Melt Technology”).

By using this Site or any Service of Melt Technology, you signify your agreement to these terms of use. If you do not agree to these Terms of Use, do not use this Site or Service. Melt Technology may modify these TOU at any time and such changes will be effective on the date that such modified TOU is posted on this Site. Use of the Site or Services after such changes have taken effect constitutes acceptance of all changes.

 

Restrictions on Use of Materials and Intellectual Property Rights


This Site or Service and all of Melt Technology’ products, trade names, marks, and logos are protected by copyright, trademark, and other intellectual property laws, and all intellectual property rights therein belong to Melt Technology and/or its affiliates and/or its suppliers (collectively, the 'Melt Technology’ Intellectual Property'). Any textual or graphic material you copy, print, or download from this Site or Service is licensed to you by Melt Technology for your personal, non-commercial home use only, provided that you do not change or delete any copyright, trademark or other proprietary notices.  You may not sell, reproduce, distribute, modify, display, prepare derivative works based on, re-post or otherwise use any of Melt Technology’ Intellectual Property in any way.

Furthermore, you may not use Melt Technology’ Intellectual Property on any other site or service, in a networked computer environment or in any other medium for any purpose. Melt Technology reserves the right to terminate your access to this Site and to use any of its intellectual property at any time.

Use of Content


By posting communications to or transmitting through the Site or Service, you hereby grant Melt Technology a royalty-free, perpetual, irrevocable, transferable, non-exclusive license to use, reproduce, modify, publish, edit, translate, distribute, perform, and display such communication(s) alone, for marketing purposes, or as a part of other works in any form, media, or technology, whether now knowns of hereafter developed and to sublicense such rights to anyone.

Anything you transmit or post may be used by Melt Technology or licensed to others by Melt Technology for any purpose, including but not limited to reproduction, disclosure, transmission, publication, broadcast and posting, or developing, manufacturing and marketing products using such information.

Conduct


As a user, you are responsible for your own actions, and the consequences of those actions. Proper conduct on the Melt Technology Site includes refraining from posting material that is:

  • Copyrighted, unless you are the copyright owner or have the permission of the copyright owner.

  • Revealing of trade secrets, unless you own them or have the permission of the owner.

  • In violation of any law or infringing on any other intellectual property rights of others, or on the privacy or 
      publicity rights of others.

  • Obscene, sexually explicit, defamatory, threatening, harassing, abusive, hateful, or embarrassing to another 
    a user or any other person or entity.

  • An advertisement, promotional material, 'junk mail,' 'Spam,' chain letter, pyramid scheme or any other form 
      of solicitation of business.

Users also must not:

  1. impersonate another person;

  2. misrepresent their affiliation with any person or organization;

  3. access the Site to obtain a list of users of the Site;

  4. use password protected, secure, or non-public areas of the Site (or frames or links to the Site) without 
      proper authorization;

  5. distribute computer viruses, worms, or any software intended to damage or alter a computer system 
      without the owner's consent; 

  6. use any mechanisms that generate excessive network traffic;

  7. either directly or through any person or entity, in any form or manner, copy, distribute, reproduce, 
      incorporate, or allow unauthorized access to the Site, its content, or the Services; or

  8. Modify, decompile, reverse engineer, disassemble or otherwise attempt to derive source code from the 
      Services.

Use of the Services for transmission, distribution, retrieval, or storage of any information, data, or other material in violation of any applicable law or regulation is prohibited.

Melt Technology does not represent or guarantee the truthfulness, accuracy, or reliability or any of communications posted by other users or endorse any opinions expressed by users. You acknowledge that any reliance on material posted by other users will be at your own risk. Melt Technology does not screen communications in advance and is not responsible for screening or monitoring material posted by users.

Melt Technology has no liability or responsibility to you for performance or nonperformance of such activities. Melt Technology reserves the right to expel users and prevent their further access to the Site or Service for violating this Agreement or the law and the right to remove communications which violate the terms of this Agreement.

System and Network Security


Violations of system or network security of the Site or Service are prohibited and may subject you to criminal and/or civil liability. Melt Technology will investigate potential security violations and may notify applicable law enforcement agencies if violations are suspected. You may not attempt to circumvent the authentication procedures or security of any host, network, network component, or account to access data, accounts, or systems that you are not expressly permitted to access.  You may not interfere or attempt to interfere with service to any other user, host, system, or network on the Internet unless expressly permitted to do so.  You may not share any passwords provided to you by Melt Technology with any third-parties.  If you would like Melt Technology to make the Site available to third parties, please make such request by e-mail to bysmamo@melttechnology.com. MELT TECHNOLOGY IS NOT RESPONSIBLE FOR ANY UNAUTHORIZED USE OR DISCLOSURE OF ANY PASSWORD

 

Disclaimers and Limitation of Liability


The materials in this Site or Service are provided 'as is' and without warranties of any kind either express or implied. Moreover, any portion of the materials available on this Site or Service may include inaccuracies or typographical errors. Changes may be made, from time to time and without notice, to the materials available on this Site or Service, the Site or Service itself, and to the products described on this Site or Service.

To the fullest extent permissible pursuant to applicable law, Melt Technology disclaims all warranties, express or implied, including, but not limited to implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, the accuracy of data, non-infringement, security, or title. Melt Technology does not warrant the accuracy, completeness or usefulness of any information contained on this Site or Service. Melt Technology does not warrant that the functions contained in the materials available on this Site or Service will be uninterrupted or error-free, that defects will be corrected, or that the materials, this Site or Service or the server that makes them available are free of viruses or other harmful components. You (and not Melt Technology) assume the entire cost of all necessary servicing, repair, and correction.

Under no circumstances, including, but not limited to, negligence, shall Melt Technology be liable for any special, incidental, indirect, or consequential damages that result from the use of, or the inability to use, Site or Service or any downloaded materials, even if Melt Technology or its representative has been advised of the possibility of such damages. In no event shall Melt Technology' total liability to you from all damages, losses, and causes of action (whether in contract or otherwise) exceed the amount you paid to Melt Technology, if any, for products purchased on this Site or Service.

Melt Technology makes no representation whatsoever regarding the content of any other site or services, which you may access from this Site or Service. When you access a third party's site or service, please understand that it is independent of Melt Technology and that Melt Technology has no control over the content on that site or service. A link to a third party's site or service does not mean that Melt Technology endorses or accepts any responsibility for the content or use of such site or service.

 

Cancellation, Refund, and Transfer Policies:


Because legal regulations vary from one governmental agency's jurisdiction to another, Melt Technology policies on issues such as cancellations and refunds may vary from location to location. Please be certain that you receive and understand the written policies documentation.

Live Online Courses & In-Person:

Registration Cancellation:

If you find it necessary to cancel your registration, please get in touch with the MELT TECHNOLOGY registration office immediately at contact@Melt-technology.com or 703-843-5413.

No Show:

A no call, no email, no show is an absence from the class without notifying the Melt Technology staff member. Refunds or transfers will not be allowed for anyone registered for a class who does not show or attend.

Refunds:


Full refunds will be given to any student/company canceling at least three full business days before the First Class. Students and/or companies will incur all charges with no refund if the student/company does not drop the class at least three business days before the first class.
A two-week notice to drop the system is required for courses that provide course materials before the first-class date, or a $500 administrative fee will be charged. Class materials or online access must be returned and canceled within 5 business days of withdrawing from the course or payment paid in full.


For courses provided by MELT TECHNOLOGY will defer to their refund/return policies as stated in their contracts and agreements. For information on a specific policy, please contact@melt-technology.com at 703-843-5413

Transfers:

A transfer will be given to any student/company if notification is provided at least three full business days before the First Class.  Students and/or companies will incur all charges with no refund if the student/company does not request the transfer at least three business days before the first class.

Substitutions:

Substitutions for one class participant for another will be approved.


Substitutes arriving on the first-class date will be required to document the substitution in writing on the class roster and complete registration materials before the beginning. Melt Technology credit will not be awarded for substitutions made after the First Class.

Course Cancellations:

MELT TECHNOLOGY reserves the right to cancel courses that do not meet minimum enrollment levels or for other good cause. Students will be notified of these cancellations before the first-class date and offered a full refund or transfer to another class.

If Melt technology closes due to weather, all in-person courses on that campus will be canceled for the day. Whenever possible, this will be emailed before 6:00 a.m. over the following stations: All class closings, please check the Melt Technology website or Melt technology social media for closing information.

Live Online courses will continue to run in virtual classrooms during inclement weather at the instructor's discretion. Contact your Live Online instructor if you have questions or cannot attend class.

Any contract training taking online will be canceled at the discretion of the trainer. Contact your MELT TECHNOLOGY representative if you have questions.

Online Fundamentals Courses:

Registration Cancellation:


Enrollments may be dropped and refunded if the start date is two months and you have not completed the course. Submit your drop request to the MELT TECHNOLOGY registration office at contact@melt-technology.com or 703-843-5413.

 

Refunds:


If you paid online bank transfer or credit card, you would be refunded in 3-7 business days. If the credit card payment took place more than 60 days before you requested the drop, a refund check would be mailed to you.

 

Transfers:


Enrollments can be transferred if the start date is within the last two months, you have not completed the course, AND you wish to move to a new session month for the same class. Please provide a transfer request with the desired session month to the MELT TECHNOLOGY registration office at contact@melt-technology.com or 703-843-5413.

 

Online Career Training Programs:

Registration Cancellation:

Enrollment cancellation may be requested within ten calendar days of the program's listed Start Date by calling 703-853-5433.

Refunds:

For refunds requested within ten calendar days of the class listed Start Date, 100% of the tuition amount shall be refunded, provided no more than 50% of the class has been completed, and all course materials are returned in as-new condition within ten days to the training at the student's expense. No refunds shall be available after the ten calendar days of the listed Start Date unless written justification is received from the student within the original access period of the student's program, and complaints are found to be valid based on the educational vendor's investigation. The student must email refund requests directly to the training. View additional refund details in the Student Enrollment Agreement.

Transfers:

You may transfer from one class to another within 60 days following your registration date. There is a transfer fee of $150, plus any applicable taxes if the transfer takes place after the first ten calendar days of the class listed Start Date. If the course you wish to transfer costs less than the original program, you shall be credited the difference minus the transfer fee. If the class you want to move prices more than the original program, you will be charged the difference, plus the transfer fee and any applicable taxes. Online Health Care Training Programs:

Registration Cancellation:

Enrollment cancellation may be requested within 14 days after the initial access to online Class materials has been granted by calling 703-843-5413. Dates regarding the entrance to the class will be based on the date of the email with the password and login for the online program.

 

Refunds:

For refunds requested within 14 days after the initial access to materials has been granted, you will be refunded in FULL, less a $50 application fee and the non-refundable shipping and handling fee. You must return all Class materials and supplies in as-new condition to the educational vendor at the student's expense before receiving the refund.
After 14 days, the student is responsible for payment of the entire class, and the cost of the Class materials is non-refundable. A $100 tuition fee is only refundable up to 60 days after the date of enrollment.

General Policies:

Certificates of Completion:

Melt Technology does not provide Certificates of Completion. Individual participants will NOT receive a certificate. 

Changes to Class Offerings:

Melt Technology reserves the right to modify or cancel programs and substitute presenters without notice at Melt Technology's discretion.

Confirmation of Registration:


Your class reservation is confirmed by payment of the fee. You must include an email address in your online registration account or registration form to receive an automatic confirmation email when the registration has been processed. Please be sure to mark your class information on your calendar. You will be notified only if your class has been canceled or is already filled.

Continuing:

Melt Technology is a nationally recognized means of recording non-credit studies. Many employers and re-licensure agencies accept them as evidence of your serious commitment to career advancement and the maintenance of professional competence. One MT is defined as ten contact hours of satisfactory participation in an organized continuing education experience under responsible sponsorship, capable direction, and qualified instruction.

Copyright:

All programs are copyrighted; therefore, video, audio, and/or photographic recordings are not permitted. Materials distributed as a part of any Class entitled the user to reference the materials, but not reproduce, distribute, or store them electronically, photographically, video graphically, digitally, or by any other means.

Disclaimer:

Course offerings at Melt Technology do not constitute an offer for a contract between Melt Technology and others. Melt Technology reserves the right to change any provisions, offerings, or requirements at any time to provide better service in the interest of Melt Technology and its students. The Melt Technology further reserves the right to ask a student to withdraw when it considers such action appropriate. Students are responsible for understanding public announcements regarding changes.

Payment Policy & Forms of Payment:

Full payment may be required at the time of registration for individuals enrolling for participation in a course. Most of our course fees include instructional materials and the use of related materials during the period established for instruction. Occasionally, students will be advised to purchase their book(s), subscriptions, or other materials in advance.


Melt Technology will not be liable for unusable or non-refundable expenses incurred in anticipation of participation in a class that is canceled for any reason. Payment for individual registrations may be made by personal or company check, money order, credit card (Visa, MasterCard, and Discover accepted), cash, bank transfer, or submitting a request for third-party authorization (Bill-to-company). An authorized representative must approve a third-party license of the company.

Registration & Class Availability:

Registration in any Class may be made via the instructions outlined in the Registration section of this website. As registrations are accepted on a first-come, first-served basis, we encourage registering early. Because most training sessions are maintained with strict census limitations, waitlists will be established for programs that exceed capacity. All space is subject to availability. Software Licensing:


All software used in the presentation of our programs has been licensed to Melt Technology for its exclusive use in an educational setting. Class participants are prohibited from copying, transmitting, or otherwise moving the software in any form. Students are NOT allowed to share class materials with none registered students or family members.

Tax Deduction for Educational Expenses:


Class fees and expenses for professional development (including travel, meals, and lodging) paid to maintain and improve professional skills may be tax-deductible. The Center for Business and Industry recommends that you seek the advice of the IRS or a qualified tax advisor to determine your individual status.

 

General Provisions


This Site or Service is controlled and operated by Melt Technology from its offices within the Accokeek MD, United States of America. Melt Technology makes no representation that materials in the Site or Service are appropriate or available for use in other locations. Those who choose to access this Site or Service from other locations do so on their own initiative and are responsible for compliance with any applicable national, state or local laws.

This agreement and the use of this Site shall be governed by and construed in accordance with laws of the State of California, United States of America, without giving effect to any principles of conflicts of law. If any provision of this agreement is held to be unlawful, void, or for any reason is unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. Any legal action or proceeding relating to your access to, or use of, the Site or Service or Melt Technology Intellectual Property on or through this Site or any purchase of Melt Technology products on or through this Site will be instituted in a state or federal court in Orange County, California. You waive any right you may have to move or dismiss or transfer on the basis of personal jurisdiction or venue, or for the convenience of any party or witness. This is the entire agreement between the parties relating to the subject matter hereof and you agree to indemnify Melt Technology for any claims or damages resulting from your failure to abide by these terms and conditions.
